Trademark Infringement Lawsuit Filed Over Domain MacPoker.com

Protos Marketing, the owners of Poker News Daily, MacPoker.com and MacPoker.net are being sued for trademark infringement. Daniel Moravec of the Best Odds Corporation says that MacPoker.com interferes with his domain MacPokerOnline.com and his pending trademark on the term “Mac Poker.” So far Protos Marketing has shelled out $50,000 in litigation fees alone but Michael Jackness, Protos Marketing’s Chairman of the Board, says that they will not let the sites go without a fight.

Jackness reached out to the online poker community, asking its members to sign affidavits stating that “Mac Poker” is a generic term and therefore should not be trademarked. He said, “If you optimize or promote anything related to ‘Mac Poker,’ we believe this should be of great concern to you. Even if you don’t compete for those terms, this may still be a precedent that you, like we, would like to avoid setting.”
 
Jackness who posts on the Poker Affiliates Listings forums under the screen name “protosmarketing,” has asked those who are interested in signing the affidavit to PM their e-mail addresses to him so that the company’s lawyers can send them the proper paper work.
 
Members of the forum appeared to be very opinionated about the issue. One member, “Jeremy” said, “This is pretty shady in my opinion. It would be the equivalent of me trying to trademark the words ‘poker affiliate’ and shut down PAS or vice-versa.” Many members suggested that Jackness counter sue but Jackness said, “we’ve already spent $50K on this and I would rather just end this nonsense. No one is actually wining here except the lawyers.”
